Within this page, the references “we”, “us”, and “our” pertain to Gabi fabrics. By using our website and / or making a purchase, you actively participate in our service and agree to abide by the ensuing terms and conditions, including our privacy policy.
The following ‘Terms & Conditions’ govern all goods purchases made on the website.

General terms & conditions
Terms of payment and checkout
By placing an order, it is your responsibility to ensure that the selected product(s) have the correct colors and sizes. We have taken great care to present our products on the website with the utmost accuracy in terms of colors and images. However, please keep in mind that the display of colors on your computer monitor may not always be entirely accurate. We value transparency and want to ensure you have the best shopping experience. Please note that all submitted orders are considered final.
Upon placing an order to buy a product, you will receive an Order Confirmation email as a receipt to confirm that your order has been received. This email serves as proof of receipt and confirms that your order is being processed, and prepared for shipping. In the case that there is an outstanding balance associated with the order, an Order Invoice will be sent. Gabi fabrics reserves the right to cancel your order in the event of technical issues, delivery failures, or similar circumstances. Should your order be canceled by Gabi fabrics, you will be promptly notified, and any payment made or reservation held using a payment method will be refunded or canceled accordingly.

Shipping
We take great care in reviewing and processing your order, and we strive to dispatch it as promptly as possible. We do our utmost best to deliver your order within the estimated time frame, however unforeseen circumstances as well as strikes and national holidays, may lead to longer delivery times. In the unlikely scenario, the delivery time exceeds 30 days, you have the option to cancel your order.

We presently offer shipping to the following countries:
BENELUX & Germany, 1-2 business days
European Union (EU) countries other & rest of Europe, 2-8 business days*
*On average for European Union countries, expect a delivery time of 2-4 business days. Deliveries to rest of Europe may take up to 8 business days.
United Kingdom, 2-3 business days
United States of America, 4 business days
Delivery
All purchases made with Gabi fabrics are insured from the moment of dispatch until they are received and acknowledged at the designated delivery address. Customers are required to sign for the receipt of their delivery, indicating the transfer of responsibility for the purchase to the customer.
Duties and taxes to non-EU countries
Please not that for all shipments to non-EU countries the responsibility for all import duties, customs, and local taxes lies with the customer. To facilitate the release of your order from customs upon arrival, payment for these charges will be necessary.
It's important to keep in mind that the precise amount of these charges cannot be provided by Gabi fabrics as they may vary. The designated shipping company will be in touch with the customer once the purchase arrives in customs, and communicate the specific amount of additional costs. Be aware that in cases where customers do not cover the import taxes, Gabi fabrics retains the right to charge the customer for the incurred expenses.
Right of withdrawal
You have the right to withdraw your purchase within 14 days of receipt of the product(s).
To initiate the return process, send us an email at contact@gabifabrics.com to notify us of your intent to return the item. Once we receive your email, we will promptly provide you with the necessary return documents. Please note that you are responsible for the return cost of shipping.
After you have submitted your withdrawal notice, we kindly request that you return the items as soon as possible and no later than 7 days from the time you changed your mind. We reserve the right to withhold the refund until we have received the product(s).
Once the return has been approved, all successfully returned items will be refunded to the original payment card used for the purchase. Please note that the original shipping charges will not be reimbursed. An email notification will be sent to you once the refund process has been initiated. It is important to note that it may take up to 14 business days for the refund to be credited to your account.
Returns & exchanges / warranty
Returns
Gabi fabrics will refund the full amount of the returned product(s) as stated in the Right of Withdrawal section, granted that all product(s) are returned in the same condition as received. The product(s) must not be damaged, washed, soiled or altered in any way. The product(s) may only be tried on as you would in a store, keeping the labels and tags, intact. All products must be returned in its original packaging.
If the item(s) are returned in any manner other than as described above, we will deem the item(s) as used, and your right of return may be partially or entirely forfeited.
Please note that the customer bears the responsibility for covering the expenses associated with the return shipping cost.
For further details on our return process, please refer to the return documents that will be sent to you per email, following a return request.
Warranty in case of defects
As the seller, Gabi fabrics, is responsible for providing statutory warranty, which means we will ensure free repair or replacement in the case the product(s) is not sound upon receipt.
If the product(s) is found to be defective or incorrect upon receipt, we will address the issue at no cost to you, given that you report the complaint within a reasonable timeframe. Hence, you will be eligible for a refund of the purchase price as well as any associated delivery costs.
However, if the item has been damaged due to misuse or mishandling, we are not obliged to provide a free resolution.
Depending on the situation, we may repair, replace or if the problem is severe, provide full refund. If the issue is minor and not eligible for repair, replacement, or termination, we may offer a discount.
Copyright & prohibited uses
Gabi fabrics places great importance on safeguarding its intellectual property. You may not appropriate any of our intellectual property. That includes all the content displayed on the website such as, images, video material, logo’s, icons, illustrations, textual content, website design, products, which are exclusively owned by Gabi fabrics, in accordance with Dutch law.
In addition to prohibition of infringement upon our intellectual property rights, it is explicitly prohibited to utilize the website or its content for unlawful purposes and to solicit others to partake in illegal activities.
Violation of any of these prohibited uses may lead to the termination of your access to the service or any affiliated website.
Retention of title
The ownership of the product(s) remains with Gabi fabrics until the customer has completed the full payment. In the event of customer bankruptcy or similar circumstances, we retain the right to reclaim the goods, in accordance with applicable laws and regulations.
Force majeure
We cannot be held liable for any delays or failures to fulfill our obligations as stated in the Terms & Conditions, in circumstances beyond our control.
Website updates
We make every effort to ensure the prices, offers, product descriptions and other information related to our products are accurate. Kindly note that there may be occasional instances of typographical errors and inaccuracies in pricing, offers, descriptions, or other information. If any incorrect prices are listed for our products, we retain the right to rectify such errors, and we shall not incur any liability on our part towards you.
